This is the English version of our terms of use. The German version at ink-me.de/nutzungsbedingungen is authoritative; in case of discrepancies, the German text prevails.
These Terms of Use govern the use of the InkMe app and the connected services ("InkMe" or the "service"). The provider (hereinafter "we") is the entity named in Section 16 at the end of these Terms; you can reach us at info@ink-me.de. By registering for or using InkMe, you accept these Terms.
InkMe lets you create content (including images and widgets) and send it to your InkMe eInk displays. Part of the feature set are optional AI features for generating and editing images (see Section 5), widgets that show third-party content such as calendars, news, weather and market prices (see Section 8), and the option to share a display with other users (see Section 7).
An account is required to use the service. You are obliged to keep your credentials secret and are responsible for all activity via your account. You can delete your account at any time in the app under Profile → Delete account.
When using InkMe – in particular when uploading, creating, generating or sending content – it is prohibited to use or create content that:
You are solely responsible for the content you upload, create and generate, and for its further use.
InkMe offers optional features to generate images using artificial intelligence and to edit existing images. These are provided via third-party services, currently OpenAI and Google (Gemini).
When you trigger an AI feature, your input (the "prompt") is transmitted to the respective provider – for image editing, additionally the image you selected. The providers' policies apply in addition; the prohibited content in Section 4 applies to prompts and uploaded images accordingly.
AI-generated content may be inaccurate, unexpected or not unique. For safety reasons, inputs or results may be filtered or rejected. Provision is "as is" without warranty of specific properties, accuracy, originality or legal protectability.
To the extent legally possible, you may use the images you generate within the scope of these Terms and the providers' policies. We do not warrant that generated content is free of third-party rights or belongs exclusively to you.
Images created with AI are considered AI-generated. If you reuse them outside InkMe, you are yourself responsible for any required labelling as AI-generated content.
InkMe can be used free of charge in its basic version. Optionally, you can subscribe to InkMe Plus to unlock additional features.
With an active Plus subscription, the following are additionally available:
These limits protect operation against overload and abuse. They are the values currently in effect; changes are governed by Section 6.6.
InkMe Plus is offered as a subscription with a term of one month. The price is currently €4.99 per month including VAT. The price shown to you immediately before purchase in the App Store always applies; in other countries and currencies it may differ. Whether an introductory or trial period is offered is also shown before purchase in the App Store.
The subscription renews automatically for another month unless you cancel it at least 24 hours before the end of the current period. Payment is charged within the last 24 hours of the current period via the payment method stored in your App Store account.
You can cancel at any time and without giving reasons in your Apple ID settings under Subscriptions – or directly in the app under InkMe Plus → Manage subscription. Cancelling with us is neither necessary nor technically possible. The subscription then ends at the close of the period already paid for.
Purchase and processing of the subscription run exclusively through the Apple App Store. The contracting party for the payment is therefore Apple and not us; we never receive payment data. Invoicing, refunds and any right of withdrawal are governed by Apple's terms. You request a refund at reportaproblem.apple.com – we ourselves can neither collect nor refund payments.
If your subscription lapses, your content is preserved: you can still view it, send it to your displays and delete it. However, the Plus features are then no longer available – in particular, running playlists and daily plans are no longer executed automatically and can no longer be created or changed.
If your used storage exceeds the free version's quota, you cannot upload new content until you have freed up enough space again. We do not delete existing content because of this.
We may adjust the scope and the limits stated in Section 6.1, for example if the cost of the services used changes or features are further developed. We will inform you of changes that noticeably disadvantage you at least 30 days in advance, in the app or by email; you may cancel the subscription before they take effect. Apple additionally notifies you of price changes in advance.
You can share a display with other InkMe users – via their e-mail address or via an invitation code that you pass on. Invitation codes are single-use and expire after seven days; only pass them to people you deliberately want to grant access to.
Anyone who has been granted a share can see the display and put content on it: send images, set up and change widgets, and replace content that is already configured. As the owner you can see whom you have shared with and can revoke a share at any time; anyone with access can also give it up themselves.
Section 4 applies unchanged to content you send to a shared display. In particular, do not send content that is evidently unwanted by the other people involved or that infringes their rights. If you pass on or sell a display, revoke the shares beforehand.
Some widgets show content that originates from third parties – news feeds, calendars, shared photo albums, artworks from museum collections, as well as weather, price and market data. The respective providers are responsible for that content; we give no warranty as to accuracy, completeness, timeliness or continued availability. If a provider changes or discontinues its interface, the feature concerned may cease to work.
If you add a source yourself (e.g. a calendar or feed address, or a link to a shared album), you ensure that you are entitled to do so.
Prices and market data are not investment advice. The prices shown in the markets widget are for information only, come from publicly accessible sources, may be delayed, incomplete or incorrect, and are not suitable as a basis for investment decisions. We recommend neither the purchase nor the sale of financial instruments and are not liable for decisions you make on the basis of this display.
The rights in the content you upload remain with you. You grant us the simple, operationally necessary right to store, process and deliver your content to your displays. If you share a display (Section 7), this right also covers delivery to that display and showing the content set up there to the people entitled to it.
If you send us a widget request or another suggestion, we may use that idea to develop InkMe further, without remuneration and without limitation in time. There is no entitlement to implementation or to a reply. This does not affect the content you upload.
We strive for reliable operation but cannot guarantee uninterrupted availability. Maintenance, faults or changes to the feature set may lead to temporary restrictions.
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.
In the event of violations of these Terms – in particular Sections 4 or 5 – we may remove content and suspend access temporarily or permanently. You can end use at any time by deleting your account; a running subscription must additionally be cancelled as described in Section 6.3, since we cannot end it for you.
We may adapt these Terms where necessary for good cause (e.g. a changed legal situation or feature set). We will inform you of material changes in an appropriate manner.
These Terms are concluded between you and the provider (Section 16) only, not with Apple. Apple is not responsible for the app or its content. The licence granted to you is a non-transferable licence to use the app on any Apple-branded device you own or control, as permitted by the App Store Terms of Service. Maintenance and support for the app are our responsibility, not Apple's, and Apple has no obligation to provide them. To the extent permitted by law, any statutory warranty is our responsibility. We — not Apple — are responsible for addressing any claims relating to the app (e.g. product liability, legal or regulatory non-compliance, or consumer protection). If a third party claims the app infringes their intellectual property, we — not Apple — are responsible for the investigation and defence of that claim. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
The law of the Federal Republic of Germany applies, without prejudice to mandatory consumer-protection rules of your country of residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
